Brainote AITerms of Use
These Terms of Use ("Terms") govern your use of the Brainote AI app and the website brainote.ai (the "Service"), published by The Anemone Lab ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. The Service
Brainote AI is a study app that uses artificial intelligence to turn the sources you import (PDF, Word and PowerPoint documents, texts, YouTube videos, audio files and live recordings) into notes, summaries, quizzes, flashcards, mind maps and audio podcasts. We may improve, change or remove features over time.
2. Your account
You need an account to use the Service, created with Sign in with Apple or Sign in with Google. You must be at least 13 years old, or the minimum age required in your country, and have your parent's or guardian's permission if you are a minor. You are responsible for the activity on your account and for keeping access to your Apple or Google account secure. You can delete your account at any time from the app (Settings → Delete account).
3. Free plan and Brainote Pro
- The free plan lets you try the Service with limits, for example on the number of notes you can create and on some features. These limits are shown in the app and may change.
- Brainote Pro is an auto-renewable subscription (for example weekly or yearly) that unlocks the Pro features. The price, period and any free trial are shown in the app before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically at the same price and period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the end of the current period.
- If a free trial is offered, any unused part of it ends when you buy a subscription. If you do not cancel at least 24 hours before the trial ends, the subscription starts and is charged.
- You can manage or cancel your subscription in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app or your account does not cancel it.
- Purchases are handled by Apple and subject to Apple's terms. Refund requests go through Apple at reportaproblem.apple.com, except where the law gives you other rights.
- Special offers (for example a discounted yearly plan) are subscriptions like any other: they renew at the price shown in the offer unless cancelled.
4. Your content
You keep all rights to the content you import and to the study materials created from it for you. You give us a limited, worldwide, non-exclusive license to host, copy, process and transmit that content, including to our AI providers, only to provide the Service to you. This license ends when you delete the content or your account.
You confirm that you have the right to use the content you import (for example your own course materials, or content you are allowed to use for personal study) and that it does not break the law or anyone else's rights.
5. AI-generated content
Notes, quizzes, flashcards, mind maps and podcasts are generated automatically by AI models. They can be incomplete or contain mistakes. They are study aids, not professional advice (medical, legal, financial or other): check important information against your sources before relying on it, especially for exams.
6. Acceptable use
You agree not to:
- import or generate illegal, hateful, violent or sexually explicit content, or content that infringes someone else's rights;
- use the Service to cheat in a way that breaks your school's or exam's rules, or to deceive or harm others;
- attempt to access other users' data, bypass usage limits or payments, overload, reverse-engineer or disrupt the Service;
- use automated means (bots, scrapers) to access the Service, or resell it without our permission.
We may suspend or close an account that seriously or repeatedly breaks these rules, after notifying you where possible.
7. Our intellectual property
The app, the website, the Brainote name, logo and mascot, and their design and code belong to The Anemone Lab and its licensors. We give you a personal, non-transferable right to use the app for your own study, under these Terms and the Apple Standard End User License Agreement.
8. Availability
We work to keep the Service available and your data safe, but we cannot guarantee that it will always be available, uninterrupted or error-free. Some features depend on third-party services (for example YouTube captions) that may change or stop working. We recommend exporting notes that matter to you.
9. Liability
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages, loss of data, or results obtained from AI-generated content. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the mandatory laws of your country of residence.
10. Changes to these Terms
We may update these Terms as the Service evolves. The date at the top shows the latest version. If a change is significant, we will tell you in the app before it takes effect. If you continue to use the Service after that, the new Terms apply; if you disagree, you can stop using the Service and delete your account.
11. Applicable law
These Terms are governed by French law. If you are a consumer, this choice does not deprive you of the protection of the mandatory consumer laws of your country of residence. Before any legal action, please contact us so we can try to resolve the issue amicably. Failing that, any dispute will be brought before the competent French courts, unless the law allows or requires you to bring it before the courts of your place of residence.
